1. Acceptance of Terms

By downloading, installing, or using the Out Of Nine mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Out Of Nine is a loyalty rewards program for café customers. Through the App, you can:

  • Create an account and earn "Nines" (loyalty points) with each qualifying purchase
  • View your Nines balance and transaction history
  • Present a secure QR code at participating locations for staff to scan
  • Redeem rewards as they become available

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 13 years old to create an account.
  • One account per person. Duplicate accounts may be terminated.

4. Nines & Rewards

  • Nines are earned automatically when a staff member scans your QR code during a qualifying purchase.
  • Earning rate: you earn 1 Nine for every fixed peso amount spent on a qualifying purchase, rounded down. Each participating location sets its own rate and may run promotional rates. The rate in effect, and the exact Nines credited for every purchase, are shown in the app on your home screen and in your transaction history.
  • Redeeming: perks, deals, stamp cards, and memberships each show their exact Nines price in the app before you confirm. No perk is redeemed without your confirmation.
  • Nines have no cash value and cannot be exchanged, transferred, or sold.
  • We reserve the right to modify the earning rate, redemption options, and Nines program rules at any time.
  • Nines do not expire. Your balance is retained for as long as your account is active.
  • Any fraud, abuse, or manipulation of the loyalty system may result in forfeiture of Nines and account termination.

5. QR Code Usage

  • Your QR code is uniquely tied to your account and is for your personal use only.
  • Do not share, screenshot, or allow others to scan your QR code on your behalf.
  • QR codes are time-limited and rotate periodically for security purposes.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or hack the App
  • Create fake accounts or use automated tools to interact with the App
  • Impersonate another person or misrepresent your identity
  • Interfere with or disrupt the operation of the Services

7. Account Deletion

You may delete your account at any time through the App settings. When you delete your account:

  • Your profile and personal data will be permanently removed within 30 days
  • Your Nines balance will be forfeited
  • Transaction history will be anonymized
  • This action is irreversible

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Out Of Nine and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of Nines, loss of data, or business interruption.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

12. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for any violation of these Terms or for any other reason.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or the use of the App shall be resolved in the courts of the Philippines.
